These Repair Terms of Service (the “Agreement”) apply to all repair services (the “Services”) and govern your utilization of the Services and Website (defined below).

By accessing or using the Services, you are indicating your acceptance and agreement to abide by the terms and conditions set forth in this Agreement. If you do not agree with any of these terms, you should refrain from using the Services.
Definitions: In this Agreement: (a) “We,” “Our,” or “Us” refers to Intellifix and its employees, executives, owners, and successors (b) “You” or “Your” refers to any individual or business using the Services, and any entity represented by such individual; (c) “Service Authorization & Estimate” means the document provided to You outlining the Services and estimated costs; (d) “Device” refers to the eligible device identified in the Service Authorization & Estimate.
Privacy Policy: Your use of the Services and Website may involve the collection of information about You and Your Device. Please review Our Privacy Policy available at [insert link to privacy policy], which explains how We collect, use, and disclose information related to Your use of the Services. By utilizing the Services, you agree to the gathering, utilization, and sharing of your information in accordance with the terms outlined in the Privacy Policy
Representations: By using the Services, You represent that You are the owner of the Device or have the authority to consent to its inspection and repair. We reserve the right to decline Services if We determine You are not the owner or authorized user. You also represent that any information or data provided to Us is not confidential or proprietary.
Authorizations: By using the Services, You authorize Us to perform the agreed-upon Services, including repairs and technical support as specified in the Service Authorization & Estimate. You agree to the inspection and repair of Your Device, and acknowledge that repairs may involve permanent changes.
Scope of Services: Services include repair of Your Device, related operating systems, and software applications. We may use new, rebuilt, or refurbished parts. Services are not covered under the original manufacturer’s warranty, and may void such warranty.
Service Availability: Services are available during operating hours at designated stores and service centers. Onsite or in-home Services are subject to location and eligibility criteria. We reserve the right to cancel Services if deemed cost prohibitive.
Eligibility: Eligible Devices include smart home products and other devices as determined by Us. Service eligibility is subject to visual and physical inspection, and compliance with service criteria determined at Our discretion.
Data Backup: You are responsible for backing up all data on Your Device and protecting it from unauthorized access. We are not liable for any loss, alteration, or corruption of data, and may decline to provide Services if adequate backup measures are not taken.
Abandonment: If You fail to pick up Your Device within sixty (60) days after completion of Services, Your Device may be deemed abandoned and become Our property, subject to applicable law.
Replacement Devices: We are responsible for safekeeping Your Device while in Our possession. In case of loss, theft, or damage during Service, We will repair or replace Your Device as determined by Us.
Limited Warranty: Repairs and parts used are warranted for one (1) year from completion of Services, subject to specified exclusions and limitations.
Indemnification: You agree to indemnify and hold Us harmless from any claims or liabilities arising from Your use of the Services or breach of this Agreement.
Limitation of Liability: We are not liable for any damages arising from Service delays, inability to use Services, or data loss, even if advised of such potential damages.
Dispute Resolution: Any disputes shall be resolved through binding arbitration in Saint Augustine, Florida, administered by the American Arbitration Association, with proceedings conducted on an individual basis.
Changes to Agreement: We may update this Agreement, with changes becoming effective upon posting on the Website. Your continued use of the Services constitutes acceptance of any revised terms.
Severability: If any provision of this Agreement is found invalid, illegal, or unenforceable, the remainder of the Agreement shall remain in full force and effect.
Governing Law: This Agreement is governed by the laws of the State of Florida, excluding conflicts of law principles.
Headings: Section headings are for convenience and do not affect the interpretation of this Agreement.
Waiver: No waiver of any provision shall be effective unless in writing.
Force Majeure: We are not liable for Service delays or failures due to causes beyond Our control.
Entire Agreement: This Agreement supersedes all prior agreements and understandings.
